For VA procurements, a contracting officer may award a sole source contract to a VOSB or SDVOSB as set forth in the VAAR. A contracting officer may award a sole source contract to an SDVOSB for non-VA procurements only when the contracting officer determines that:
  1. (a)None of the provisions of § 128.403 or § 128.404 apply;
  2. (b)The anticipated award price of the contract, including options, will not exceed:
    1. (1)$7,000,000 for a contract assigned a manufacturing NAICS code; or
    2. (2)$4,000,000 for all other contracts;
  3. (c)A SDVOSB is a responsible contractor able to perform the contract; and
  4. (d)Contract award can be made at a fair and reasonable price.
