2 CFR §200.105

1. (a)Superseding inconsistent requirements. For Federal awards made subject to this part by a Federal agency, this part takes precedence over any administrative requirements, program manuals, handbooks, and other non-regulatory materials that are inconsistent with the requirements of this part upon implementation by the Federal agency, except to the extent that they are required by statute or authorized in accordance with § 200.102.
2. (b)Imposition of requirements on recipients. Agencies may only impose legally binding requirements on recipients and subrecipients through:
   1. (1)Notice and public comment procedures through an approved agency process, including as authorized by this part, other statutes, or regulations; or
   2. (2)Incorporating requirements into the terms and conditions of a Federal award as permitted by Federal statute, regulation, or this part.
