  1. (a)Except as provided in paragraph (b) of this section, the provisions of this subpart apply to all Federal-aid construction projects.
  2. (b)This subpart does not apply to engineering and design service contracts, to which 23 CFR part 172 applies, or Federal Lands Highway contracts, to which 48 CFR subpart 16.5 applies.
