  1. (a)The Secretary must issue a written decision explaining the rationale for denying or approving the requested waiver.
  2. (b)If the Secretary issues a written decision denying the requested waiver, it must describe the basis for the specific finding that the identified text in the regulation may not be waived because such a waiver is prohibited by Federal law.
  3. (c)The decision is final for the Department.
