  1. (a)The Tribe/Consortium remains eligible to negotiate a compact and funding agreement at any time unless:
    1. (1)It does not satisfy the eligibility requirements under 25 U.S.C. 5362(c); or
    2. (2)Submits a Tribal resolution or official action by the Tribal governing body to the Director, OSG requesting to withdraw its request to participate in Self Governance.
  2. (b)Whether or not a Tribe/Consortium executes an agreement has no effect on the selection of up to 50 new Tribes/Consortia in a subsequent year.
