25 CFR §41.11

  1. (a)A Tribal college or university is eligible for financial assistance under this subpart only if it:
    1. (1)Is governed by a board of directors or board of trustees, a majority of whom are Indians;
    2. (2)Demonstrates adherence to stated goals, a philosophy, or a plan of operation directed to meet the needs of Indians;
    3. (3)Has a student body that is more than 50 percent Indian (unless it has been in operation for less than one year);
    4. (4)Is either:
      1. (i)Accredited by a nationally recognized accrediting agency or association determined by the Secretary of Education to be a reliable authority with regard to the quality of training offered; or
      2. (ii)Is making reasonable progress toward accreditation according to such agency or association;
    5. (5)Has received a positive determination after completion of an eligibility study; and
    6. (6)Complies with the requirements of § 41.19.
  2. (b)Priority in grants is given to institutions that were in operation on October 17, 1978, and that have a history of service to Indian people.
