  1. (a)This subpart applies when the Secretary gives notice to an Indian tribe or tribal organization that the Secretary intends to:
    1. (1)Immediately rescind a contract or grant and reassume a program; or
    2. (2)Suspend, withhold, or delay payment under a contract.
  2. (b)When the Secretary advises an Indian tribe or tribal organization that the Secretary intends to take an action referred to in paragraph (a)(1) of this section, the Secretary shall also notify the Deputy Director of the Office of Hearings and Appeals, Department of the Interior, 801 North Quincy Street, Arlington, VA 22203.
