It applies to:
  1. (a)All tort claims arising from the performance of self-determination contracts under the authority of the Act on or after October 1, 1989; and
  2. (b)Any tort claims first filed on or after October 24, 1989, regardless of when the incident which is the basis of the claim occurred.
