43 CFR §4.790

If the Board issues a decision remanding a case to the presiding officer, the presiding officer:
  1. (a)May, subject to any directions or restrictions in the Board's decision and § 4.315, do one or more of the following to resolve any issues of fact or law:
    1. (1)Request information from the Project Director and the parties in interest or other persons or entities;
    2. (2)Schedule and hold a prehearing conference;
    3. (3)Schedule and hold a hearing; or
    4. (4)Take any other action authorized by this subpart; and
  2. (b)Will issue an order upon remand determining the issues of fact or law.
