  1. (a)If an employee timely files a petition for a hearing under § 708.6, the Deputy Staff Director shall select the time, date, and location for the hearing.
  2. (b)The hearing shall be conducted by an impartial hearing official.
  3. (c)The Commission, as the creditor agency, will have the burden of proving the existence of the debt.
  4. (d)The employee requesting the hearing shall have the burden of proof to demonstrate that the existence or amount of the debt is in error.
