  1. (a)Issuance. At any time before the issuance of an Order Assessing Civil Penalty under this subpart, an agency attorney and a person subject to a Notice of Proposed Civil Penalty, or an agency official and a person subject to a Notice of Violation, may agree to dispose of the case by the issuance of a compromise order by TSA.
  2. (b)Contents. A compromise order contains the following:
    1. (1)All jurisdictional facts.
    2. (2)All allegations.
    3. (3)A statement that the person agrees to pay the civil penalty specified.
    4. (4)A statement that TSA makes no finding of a violation.
    5. (5)A statement that the compromise order will not be used as evidence of a prior violation in any subsequent civil penalty proceeding.
