Except for the takings described in § 217.312 and authorized by a LOA issued under § 217.316 or § 217.317, it is unlawful for any person to do any of the following in connection with the activities described in this subpart.
  1. (a)Violate or fail to comply with the terms, conditions, and requirements of this subpart or a LOA issued under §§ 217.316 and 217.317.
  2. (b)Take any marine mammal not specified in § 217.312(c).
  3. (c)Take any marine mammal specified in § 217.312(c) in any manner other than specified in § 217.312(a) and (b).
  4. (d)Take any marine mammal, as specified in § 217.312(c), after NMFS determines such taking results in more than a negligible impact on the species or stocks of such marine mammals.
