  1. (a)The parties to the hearing shall be the respondent and USDA. The proceeding shall be brought in the name of the Secretary.
  2. (b)Pursuant to 31 U.S.C. 3730(c)(5), a private party plaintiff under the False Claims Act may participate in proceedings under this subpart to the extent authorized by the provisions of that Act.
