Eligible organization means an organization eligible to nominate members of the Board and which meets the following criteria:
  1. (a)Is a nonprofit organization pursuant to section 501(c) (3), (5), or (6) of the Internal Revenue Code (26 U.S.C. 501(c) (3), (5), or (6));
  2. (b)Is governed by a board comprised of a majority of fluid milk processors; and
  3. (c)Represents fluid milk processors on a national basis whose members process more than 50 percent of the fluid milk products processed and marketed within the United States.
