7 CFR §763.16

1. (a)Environmental compliance requirements. The environmental requirements contained in part 799 of this chapter must be met prior to approval of guarantee request.
2. (b)Determination. The Agency determination of whether an environmental problem exists will be based on:
   1. (1)The information supplied with the application;
   2. (2)Environmental resources available to the Agency including, but not limited to, documents, third parties, and government agencies;
   3. (3)Other information supplied by the buyer or seller upon Agency request; and
   4. (4)A visit to the farm.
