This subpart is an exercise of the Secretary's enforcement discretion. This subpart—
  1. (a)Is not intended to and does not supplant or limit otherwise lawful activities of the Department or the Secretary; and
  2. (b)Is not intended to and does not create any rights, substantive or procedural, enforceable at law by any party in any matter, civil or criminal.
