§ 1108.140 Debarment.
Debarment means an action taken by a Federal agency debarring official to exclude a person or entity from participating in covered Federal transactions, in accordance with debarment and suspension policies and procedures for:

(a) Without special proceeding for regulation. Every security issue within the scope of the jurisdiction conferred upon the Commission by sections 19 and 20 of the Federal Power Act shall be subject to the provisions of §20.2, except a security issue by a person organized and operating in a State under the laws of which its security
(b) Based on the Council's annual review of each State program, the following may occur:
(1) If the program conforms to the requirements of the Act, the State will be advised of its continued eligibility for a grant;
(2) If it appears that the program does not comply with the requirements of the Act in either design or administration, the Council shall ascertain all the relevant facts. The State shall be notified immediately

(c) The requirement of paragraph (a) or (b) of this section may be modified or waived by the Executive Director or the Commission if an applicant adopts and implements a program for coordinated use of ground and surface water, and the applicant demonstrates that operation of the coordinated program will be consistent with the policies contained in the Comprehensive Plan
well as urban, areas.
(b) Authorization of appropriations and reservation
(1) AuthorizationThere are authorized to be appropriated $50,000,000 for fiscal year 1994 to carry out this subchapter.
(2) ReservationThe Secretary is authorized in each fiscal year to reserve not more than 10 percent of the amount appropriated pursuant to the authority of
educational agency or local educational agency that receives funds under this chapter to mandate, direct, or control the curriculum of a private or home school, regardless or 1 whether or not a home school is treated as a private school under state 2 law, nor shall any funds under this chapter be used for this purpose.
