  1. (a)In general.
    1. (1)The requirements in §§ 2590.716-4 through 2590.716-7, 2590.717-1, 2590.722, and 2590.725-1 through 2590.725-4 apply to group health plans and health insurance issuers offering group health insurance coverage (including grandfathered health plans as defined in § 2590.715-1251), except as specified in paragraph (b) of this section.
    2. (2)The requirements in §§ 2590.716-8 and 2590.717-2 apply to certified IDR entities and group health plans and health insurance issuers offering group health insurance coverage (including grandfathered health plans as defined in § 2590.715-1251) except as specified in paragraph (b) of this section.
  2. (b)Exceptions. The requirements in §§ 2590.716-4 through 2590.716-8, 2590.717-1, 2590.717-2, 2590.722, and 2590.725-1 through 2590.725-4 do not apply to the following:
    1. (1)Excepted benefits as described in § 2590.732.
    2. (2)Short-term, limited-duration insurance as defined in § 2590.701-2.
    3. (3)Health reimbursement arrangements or other account-based group health plans as described in § 2590.715-2711(d).
