29 CFR §38.67 — Methods by which a recipient may show cause why enforcement proceedings should not be instituted.

A recipient may show cause why enforcement proceedings should not be instituted by, among other means:
  1. (a)Correcting the violation(s) that brought about the Notice to Show Cause and entering into a Conciliation Agreement, under §§ 38.91 and 38.93;
  2. (b)Demonstrating that CRC does not have jurisdiction; or
  3. (c)Demonstrating that the violation alleged by CRC did not occur.
