29 CFR §38.95 — Enforcement when voluntary compliance cannot be secured.

If the Director concludes that compliance cannot be secured by voluntary means, the Director must either:
  1. (a)Issue a Final Determination;
  2. (b)Refer the matter to the Attorney General with a recommendation that an appropriate civil action be instituted; or
  3. (c)Take such other action as may be provided by law.
