Persons managing universal waste that is imported from a foreign country into the United States are subject to the requirements of 40 CFR part 262 subpart H and the applicable requirements of this part, immediately after the waste enters the United States, as indicated in paragraphs (a) through (c) of this section:
  1. (a)A universal waste transporter is subject to the universal waste transporter requirements of subpart D of this part.
  2. (b)A universal waste handler is subject to the small or large quantity handler of universal waste requirements of subparts B or C, as applicable.
  3. (c)An owner or operator of a destination facility is subject to the destination facility requirements of subpart E of this part.
