40 CFR §52.2679

1. (a)Approvals of the following rules are limited to specific sources, since a control strategy demonstration has not been submitted showing that any increased emissions would not interfere with the attainment or maintenance of the NAAQS.
   1. (1)Rule 13.1, submitted on October 12, 1979, for all applicable sources except the Tanguisson Power Plant.
   2. (2)Rule 13.2, submitted on January 25, 1972, for the Tanguisson Power Plant.
2. (b)The following rules are disapproved because they are inconsistent with section 123(a)(2) of the Clean Air Act which requires continuous control strategies.
   1. (1)Rule 13.2, submitted on October 12, 1979.
3. (c)Effective October 20, 2025, the EPA has determined, that based on air dispersion modeling, the Piti-Cabras nonattainment area has attained the 2010 1-hour sulfur dioxide NAAQS. This clean data determination suspends the requirement for this area to submit an attainment demonstration, associated reasonably available control measures, including reasonably available control technology, a reasonable further progress plan, emissions limitations and control measures as necessary to provide for attainment, and contingency measures, for as long as this area continues to meet the 2010 1-hour sulfur dioxide NAAQS.
