40 CFR §59.697 — State actions.

The provisions in this subpart do not preclude any State or any political subdivision of a State from:
  1. (a)Adopting and enforcing any emission standard or limitation applicable to anyone subject to the provisions of this part; or
  2. (b)Requiring the regulated entity to obtain permits, licenses, or approvals prior to initiating construction, modification, or operation of a facility for manufacturing a consumer product.
