40 CFR §60.1375

1. (a)If you are required to submit an application for a construction permit under 40 CFR part 51, subpart I, or 40 CFR part 52, you must submit five items by the date you submit your application.
   1. (1)Your draft materials separation plan, as specified in § 60.1065.
   2. (2)Your revised materials separation plan, as specified in § 60.1085(c).
   3. (3)Your notice of the initial public meeting for your draft materials separation plan, as specified in § 60.1070(b).
   4. (4)A transcript of the initial public meeting, as specified in § 60.1080(f).
   5. (5)The document that summarizes your responses to the public comments you received during the initial public comment period, as specified in § 60.1085(a).
2. (b)If you are not required to submit an application for a construction permit under 40 CFR part 51, subpart I, or 40 CFR part 52, you must submit the items in paragraph (a) of this section with your notice of construction.
