  1. (a)If the plan includes services in public institutions for mental diseases, the agency must show that the State is making satisfactory progress in developing and implementing a comprehensive mental health program.
  2. (b)The program must—
    1. (1)Cover all ages;
    2. (2)Use mental health and public welfare resources; including—
      1. (i)Community mental health centers;
      2. (ii)Nursing homes; and
      3. (iii)Other alternatives to public institutional care; and
    3. (3)Include joint planning with State authorities.
  3. (c)The agency must submit annual progress reports within 3 months after the end of each fiscal year in which Medicaid is provided under this subpart.
