42 CFR §600.105

1. (a)Statutory basis. This subpart implements the following sections of the Act:
   1. (1)Section 1331(a)(1) which defines a Basic Health Program.
   2. (2)Section 1331(a)(2) which requires the Secretary to certify a Basic Health Program before it may become operational.
   3. (3)Section 1331(f) which requires Secretarial oversight through annual reviews.
2. (b)Scope and applicability.
   1. (1)This subpart sets forth provisions governing the administration of the BHP, the general requirements for development of a BHP Blueprint required for certification, for program operations and for voluntary program termination.
   2. (2)This subpart applies to all States that submit a BHP Blueprint and request certification to operate a BHP.
