  2. (b)Agency determinations. The head of the U.S. Agency for International Development has determined after consultation with the Administrator of the Office of Management and Budget's Office of Federal Procurement Policy and the Administrator of the Small Business Administration, that advance notice is not appropriate or reasonable for the following:
    1. (1)Contract actions described in 706.302-70(b)(1) through (3); or
    2. (2)A contract of $250,000 or less by an overseas contracting activity issued in accordance with the requirements in FAR part 13.
