  1. (a)An agency may appoint noncompetitively a National Guard technician who—
    1. (1)Was involuntarily separated (other than by removal for cause on charges of misconduct or delinquency);
    2. (2)Has served at least 3 years as a technician;
    3. (3)Meets the qualifications requirements of the job: and
    4. (4)Is appointed within 1 year after separating from service as a Guard Technician.
  2. (b)The noncompetitive appointing authority also applies to National Guard technicians separated before October 29, 1986, provided they are appointed within a year of the date of separation.
