40 CFR §17.2

1. (a)The Act means section 504 of title 5 U.S.C., as amended by section 203(a)(1) of the Equal Access to Justice Act, Public Law No. 96-481.
2. (b)Administrator means the Administrator of the Environmental Protection Agency.
3. (c)Adversary adjudication means an adjudication required by statute to be held pursuant to 5 U.S.C. 554 in which the position of the United States is represented by counsel or otherwise, but excludes an adjudication for the purpose of granting or renewing a license.
4. (d)EPA means the Environmental Protection Agency, an Agency of the United States.
5. (e)Presiding officer means the official, without regard to whether he is designated as an administrative law judge or a hearing officer or examiner, who presides at the adversary adjudication.
6. (f)Proceeding means an adversary adjudication as defined in § 17.2(b).
