  1. (a)The requirements of this subpart apply to owners or operators of reclamation and intermediate facilities managing hazardous secondary materials excluded under 40 CFR § 261.4(a)(24), except as provided otherwise in this section.
  2. (b)States and the Federal government are exempt from the financial assurance requirements of this subpart.
